Part A revised the §2B3.1(b)(2)(B) 2-level enhancement to apply only if a person’s freedom was physically restricted (e.g., tied or confined) and clarified the 6-level enhancement to uniformly account for firearm use during robbery. Parallel changes were made to §2B3.2 and §2E2.1. Part B clarified that traffic stops are not “intervening arrests” under the §4A1.2(a)(2) single-sentence rule.Amendment 833 (Drug Offenses)Revised §2D1.1 to address low-level roles and mens rea. Part A capped base offense levels at 30 or 32 based on §3B1.2 adjustments and added guidance for applying mitigating role adjustments (§2D1.1(e)(2)). Part B changed the mens rea for the §2-level enhancement for fentanyl marketing from “willful blindness or conscious avoidance” to “reckless disregard.”Amendment 834 (Firearms Offenses)Revised §2K2.1 to address machinegun conversion devices and added a tiered offense characteristic (§2K2.1(b)(5)) capped at level 29, applicable only to the defendant’s acts.Amendment 835 (Supervised Release)Updated Chapters Five and Seven to emphasize individualized assessments, court authority to reassess post-release, and the rehabilitative purpose of supervised release.
